Expungement
How to Expunge a Felony in Tennessee?
It is important to understand that not all criminal convictions are eligible for expungement. Certain misdemeanors and most felonies are not eligible, and you must meet the criteria set by the state’s law to be eligible to have your past conviction expunged.
Expungement may be possible in certain situations, including:
- When charges were dismissed
- After a diversion program was successfully completed
- In most Class A misdemeanor or Class E felony convictions
- When five years have passed since the conviction
- When there is only one conviction on your record
- After all court costs and probation fees have been satisfied
In 2017, new laws regarding expungement were implemented in Tennessee. Under the new law, people with two unrelated criminal convictions may be able to have the record expunged, if each offense is eligible for expungement if both offenses are misdemeanors, and when there are no other convictions.
In addition, the rules regarding partial expungements have been expanded. This is when a person has been indicted on multiple counts, but one was dismissed. Under the new law amended in Public Chapter 358, dismissed charges may be removed from government-maintained electronic databases that could potentially make it harder for a convicted individual to obtain loans, housing, and jobs.
