Under TN Code § 39-13-106 (2015), vehicular assault occurs when an intoxicated individual recklessly causes serious physical injury to another while they are operating a motor vehicle. Under the law, intoxication includes driving under the influence of alcohol, drugs, or a combination of the two.
The penalties for a first offense include:
- A 48-hour mandatory minimum jail sentence
- One-year driver’s license suspension
- Applicable fines and court costs
The penalties are higher if you are convicted for a second or subsequent offense. For example, a second conviction for an alcohol-related offense merits a mandatory 45-day jail sentence and a 2-year license suspension, while a third conviction may result in a mandatory 120 days in jail and a 3-year license suspension. It is important to note that, under the law, a conviction for any alcohol related-offense can warrant harsher penalties.
